In my experience, this is the most common misconception: the transfer of ownership in rem takes place exclusively through successful registration at the land registry. Until your ownership is registered in the property register, you are not legally the owner of the property and cannot freely dispose of it. How Does the Law Regulate the Land Registry Procedure?

Under Hungarian law, the legal framework for the land registry procedure is determined by the Act on the Real Estate Register (Inyt.). This legislation imposes strict formal and substantive requirements on the submitted deeds, which the land registry office verifies step-by-step during the administration. In the event of any formal or substantive error, the procedure can stall, representing a serious risk for the buyer.


The Schedule of the Registration Procedure in Practice

Submission of the Application and the Significance of Filing

Under Hungarian law, we are required to submit the signed contract and its related declarations to the land registry within 30 days of the date of signing the contract. In practice, my office does this immediately after signing, typically within 24 to 48 hours. Once the application is received, the land registry files it, and the fact of submission immediately appears as a marginal notation (széljegy) on the property's land registry extract. This marginal notation indicates to all third parties that a procedure is pending regarding the property, thereby preventing fraud and unauthorized transactions.

The Verification and Rectification Phase

Following the filing, the land registry officer examines whether the submitted documents comply with the statutory requirements. If they find a minor deficiency or data requiring clarification (such as an inaccurate address or a missing tax declaration form), the authority issues a request for rectification (hiánypótlás). Typically, a 15-day deadline is provided to resolve this. If the rectification is not completed in time, the authority will reject the application, which can derail the entire sale and purchase process.

Decision-making and Realization of the Registration

If the documentation is flawless, or if the rectification has been successfully completed, the land registry office makes its decision and registers the new ownership right in the property register. The decision is served to the parties and the representing attorney, officially concluding the acquisition of ownership.


How Long Does the Land Registry Procedure Take?

The processing time depends significantly on the workload of the land registry offices and the nature of the procedure. Below is a summary of the average duration of the most common types of procedures:

Ownership registration based on a simple sale and purchase agreement generally takes 30–60 days. Registering a mortgage requires a similar timeframe, while ownership registration based on inheritance is usually processed within 30–45 days. If it involves deleting an existing encumbrance (such as a bank mortgage), the authority makes a decision faster, in 15–30 days. It should be highlighted that if a request for rectification is issued, the procedure time can be extended by an additional 15–30 days. Especially in the case of Budapest land registry offices, it is advisable to expect longer processing times due to their heavy workload.


What Documents are Required for Successful Registration?

To the land registry application, we must attach the properly completed registration application form, the original sale and purchase agreement countersigned by the attorney in the number of copies prescribed by law, and the proof of payment of the administrative service fee. In addition, the NAV form for assessing the property acquisition duty must be attached, and in certain cases (such as land subdivision or registering a new building), the land survey plan (változási vázrajz) prepared by a surveyor and certified by the land registry office must also be enclosed.


Why Can the Land Registry Office Reject the Application?

The most common reason for rejection is a formal defect in the contract, or incomplete or inaccurate information. Particularly common errors include typos in the topographical number, inaccuracies in the parties' personal details, or the absence of the seller's mandatory registration consent. For properties encumbered by a right of first refusal, the procedure will be rejected immediately if we do not provide credible proof that the beneficiary has waived their right or that the purchase offer was legally communicated to them. If the 30-day deadline is missed, the land registry office may impose a late submission penalty, which represents a significant extra cost for the parties. Using the Takarnet system available online via the Client Gate (Ügyfélkapu), the land registry extract of the property can be retrieved online. In such cases, an application for correction must be submitted to the land registry office immediately.
