Before entering private practice, our founding attorney spent several years at state and local tax authorities, gaining deep familiarity with legislation from a regulatory perspective. The real estate purchase process

From the first phone call to receiving the title registration order, in brief steps:

  • You contact us by phone or email to purchase a property.
  • We consult by phone and email on the details: type of property, number of owners, any encumbrances, financing, etc.
  • We send a data request email; if questions remain after receiving it, we call you to clarify any missing information.
  • We schedule a signing appointment and confirm in advance what documents will be needed (ID, energy performance certificate, etc.).
  • We send you the draft contract by email so the seller can also review it before signing.
  • Contract signing: we read through and discuss the contract together, after which the parties sign and we countersign.
  • We submit the contract to the land registry.
  • Once confirmed receipt of the purchase price, we submit the seller’s title registration consent to the land registry.
  • The title registration order arrives and we notify all parties by email with a scanned copy.

Attorney’s fee

The attorney’s fee is primarily based on the purchase price of the property. The minimum fee in our practice is HUF 60,000 and the maximum is HUF 300,000. These are gross amounts; our law firm provides VAT-exempt services. The fee is independent of whether there is a mortgage or encumbrance in the transaction; however, for high-value or particularly complex transactions, the fee may be higher.

The attorney’s fee includes:

  • the full contract preparation process (see above),
  • preparation and countersigning of a power of attorney if needed,
  • advice on taxes and duties, consultation on optimisation options,
  • drafting and countersigning the contract,
  • land registry proceedings,
  • notification to the National Tax Authority (NAV) for duty assessment,
  • ongoing consultation throughout, and notification of all parties upon registration.

No hidden costs!

The attorney’s fee does not include the title deed retrieval fee or the procedural fee payable to the land registry. If a minor is involved in the transaction, the guardianship authority proceedings are handled by the client — we will provide full guidance on how to proceed. Upon request we can handle these as well, at an additional charge. Removal of encumbrances is handled by the seller, but we can assist upon separate request and fee. We guarantee that where the purchase price is bank-financed, the agreement will fully comply with the lender’s requirements, and we will liaise with the bank directly if needed.

What data is required for the real estate purchase agreement?

To prepare the contract, we generally need the following information from the parties:

  • For Individuals: Full name, name at birth, place and date of birth, mother’s name, permanent address, tax identification number, and identity card number.
  • For Companies: Company name, registered seat, tax number, registration number, and the name of the legal representative.

Additionally, we need to know if there are any mortgages or encumbrances on the property, and if any third parties have rights of first refusal. Our law office will obtain the up-to-date land registry title deed (tulajdoni lap).

What should I bring to the contract signing?

Please bring the following original documents to the personal meeting:

  • Valid identification document (ID card, passport, or driving license).
  • Tax card.
  • Address card.

If you are representing a company, please provide a fresh specimen of signature (aláírási címpéldány). The seller must also provide the Energy Performance Certificate (Energetikai tanúsítvány) number.

How long does the land registry process take?

The length of a real estate purchase process depends on several factors (e.g., mortgage administration, subsidies), but in general, the following schedule can be expected:

  • Contract Preparation: 1-3 business days from receiving the data.
  • Land Registry Marginal Note: Within 1 business day after submission.
  • Mortgage Administration: Usually 4-8 weeks.
  • Title Registration: 30-60 days (or 30 days for expedited procedure) after full payment and submission of the registration permit.
