What is a Mortgage and How Does It Work in Practice?
Under Hungarian law, a mortgage (jelzálogjog) is one of the most common forms of pledge, regulated by Sections 5:101–5:124 of the Hungarian Civil Code (Ptk.). It is a proprietary security (dologi jogi biztosíték) that authorizes the creditor (most frequently the bank) to satisfy its claim directly from the sale (auction) of the property if the debtor fails to perform their obligations under the contract.
In my daily practice, I most commonly encounter contractual mortgages, which secure a debt arising from a specific loan agreement (such as a housing loan or a personal loan). I also encounter independent mortgages (önálló zálogjog), which are detached from the underlying personal claim and can circulate in the credit market as independent assets.
The Mortgage Registration Procedure and Costs
The registration of a mortgage is primarily initiated by the lending bank, but the mortgage agreement serving as the basis for the registration must also be signed by the property owner. For the land registry procedure, the loan and mortgage agreement prepared by the bank, the owner's explicit consent declaration, and the submission of a proper registration application are essential. Since banks strictly condition the disbursement of the loan on the marginal notation or registration of the mortgage, the precise and rapid submission of documents is vital.
The execution of the procedure at the land registry office generally takes 30–60 days, but this duration may be longer for Budapest offices due to their heavy workload. It should be highlighted that an administrative service fee must be paid for the registration, which is currently HUF 12,600 per property.
How is a Mortgage Cancelled After the Loan is Repaid?
The full repayment of the loan does not mean that the mortgage automatically disappears from the land registry extract. To clear the title, we must conduct a separate land registry procedure. The fundamental condition for cancellation is the mortgage discharge consent (zálogtörlési hozzájárulás / törlési engedély) issued by the creditor bank, which must be countersigned by an attorney or incorporated into a public notary deed.
Once the debtor receives this certificate from the bank, the cancellation application must be submitted to the competent land registry office. After verifying the documents, the authority generally cancels the mortgage from the property's land registry extract within 30 days. The good news is that the cancellation of a mortgage in the land registry procedure is free of charge (exempt from administrative fees), so the owner does not have to worry about procedural fees.

In the contract, we precisely regulate the debt-clearance process in such cases: the buyer transfers the first installment of the purchase price directly to the bank for the final repayment of the loan, the bank issues the discharge consent, and the buyer only pays the remaining balance to the seller after this has occurred.
What is the difference between a mortgage and a ban on alienation and encumbrance?
To secure a mortgage, banks almost always register a ban on alienation and encumbrance (elidegenítési és terhelési tilalom) as well. Under Hungarian law, this means that without the bank's prior written consent, the property cannot be sold, donated, or encumbered with a new loan. Upon repayment of the loan, we cancel both the mortgage and the ban simultaneously.
What happens if the bank rejects the registration application?
If the submitted mortgage agreement or application does not meet the land registry requirements, the land registry office will order a rectification or reject the application. In this case, the bank must modify the documents. Since this delays the disbursement of the loan, I recommend that a legal expert supervise the entire process.
