Both legal instruments serve to ensure the safety of the buyer until the purchase price is paid, but there is a significant difference between them:

Title Reservation (Tulajdonjog fenntartás)

The seller retains ownership until the full purchase price is paid. This fact is recorded on the title deed of the property, so the property cannot be sold or encumbered to anyone else. After the purchase price is paid, the seller issues a separate declaration of consent (registration permit).

Pending Registration (Tulajdonjog bejegyzés függőben tartása)

The Land Registry keeps the registration application pending for a maximum of 6 months. During this time, no other rights can be registered on the property. It is advantageous if the purchase price is paid within 6 months. If the payment deadline is longer than this, title reservation must be applied.
